Facing a sexual charge?

Facing a sexual charge can be incredibly confronting. These cases often involve no independent witnesses and essentially boil down to the word of the complainant against that of the accused. The risk of receiving a prison sentence if found guilty is also high, so it pays to have excellent legal representation.

 

We are regularly instructed by clients who are being investigated for alleged sexual offending, but have not yet been charged. In such circumstances, we work closely with the client to keep them fully informed of their options and to help reduce their stress levels. If appropriate, we will also communicate with the Police as a means to reaching a sensible resolution that ideally avoids charges being pursued.

Recent Sexual Cases

A Pakistani national who had recently immigrated to New Zealand was charged with indecent assault following several incidents at his workplace. After helping the client engage in appropriate counselling, a guilty plea was entered and a discharge without conviction application was then advanced and declined in the District Court. In a precedent-setting decision in the Court of Appeal, the decision was overturned on the basis that the defendant and his family would likely be deported if the conviction remained in place.

Client faced a rape charge against a much younger complainant following a drinking session at his neighbour’s home. After a jury returned a hung verdict in the first trial, he was found not guilty at a second trial.

A 16-year-old still at school. faced an allegation of rape following an incident with another student.  After providing a written statement to the Police and some involvement with the Youth Court, the prosecution was dropped.

Client faced with serious sexual allegations made by his step-daughter. After taking instructions and providing a written statement to the. Police, no charges were pursued against the client.

International student charged with rape and unlawful sexual connection after sexual encounter with flatmate. Crown claimed he had made admissions in text messages.  Acquitted after four day trial.

20 year old charged with rape after sexual intercourse with a 16 year old. Crown claimed that the accused had made admissions in text messages to the complainant. Acquitted after four day trial.

A client was charged with indecent assault following a drunken work-place incident. After completing appropriate counselling, he was granted a discharge without conviction on the basis that he would lose his job and career path if convicted.

Taxi driver charged with indecent assault following incident where he entered a passenger’s home. Acquitted after a three day trial.
